Last night, both the federal Department of Justice and 26 states filed amicus briefs supporting CRPA's challenge to California's ammo ban.
The DOJ filed an amicus brief supporting the plaintiffs in the case of Rhode v. Bonta. In addition, 26 states collaborated on an amicus brief also supporting the case.
"This level of national and federal support for our case highlights just how audacious the State of California has been in restricting gun rights," stated CRPA President & General Counsel Chuck Michel. "The state cannot demonstrate anything close to a historical analog to Prop. 63 because the founders understood that ammunition is essential to lawful gun ownership."
Rhode v. Bonta awaits en banc review at the Ninth Circuit, the latest step in a legal fight that has gone on nearly a decade since the passage of Prop. 63. Prop. 63 imposed a regulatory scheme for ammo purchases that required a background check for every purchase, putting in place a burden that clearly violates the Constitution. Back in July, a three-judge panel at the Ninth Circuit affirmed CRPA's position in the case and ruled that the law was indeed unconstitutional. The state then requested the en banc review, which is currently calendared for March 23, 2026.
